Marla Neufeld's article was just published in the December 2019 issue of the American Bar Association's Health Lawyer publication. The article is titled, The A, B, Cs (along with CDCs and FDAs) of Regulatory Implications over Assisted Reproductive Technology and Ms. Neufeld was joined by Reed Smith health law partner, Kimberly Gold, Esq. in writing the article.

Introduction to Assisted Reproductive Technology

The article provides a brief overview of assisted reproductive technology history in the United States. It then discusses the typical medical procedures involved in assisted reproductive technology and traditional surrogacy compared to gestational surrogacy. The article then provides an overview of the various laws, agencies, organizations, and regulations that govern assisted reproductive technology such state laws, constitutional principles, the American Society for Reproductive Medicine, the Center for Disease Control and Prevention and the Food and Drug Administration, to name a few.

Privacy and Cybersecurity Concerns in Emerging ART Technology

The article then provides a fascinating look into the recent expansion of assisted reproductive technology into more unique advancements in tools such as fertility and period tracking applications, female health tracking features, smart tampons, and other women's health technologies coined as "Femtech".
